How to classify a working relationship
- Test control, not labels. Who decides what is done, how, when and where? The more the company directs the manner of work rather than just the deliverable, the more the relationship looks like employment in most jurisdictions, whatever the contract says.
- Test economics and integration. Contractors carry business risk: their own tools, multiple clients, invoices, the chance of profit and loss. A person working full-time for one company, inside its systems and management chain, reads as an employee almost everywhere.
- Match the instrument to the answer. A genuine contractor can be engaged directly or through a contractor management platform. A relationship that fails the tests should be converted to employment, locally or through an employer of record where you have no entity.
Why the same person can be classified differently by country
Each jurisdiction applies its own version of the tests: common-law control tests, statutory presumptions, or multi-factor rules, and some countries presume employment unless the company proves otherwise.
