One employee moving across a state line turns a simple payroll into a multi state payroll, and the consequences reach further than withholding. Registration, unemployment insurance, local taxes and sometimes corporate tax presence all follow the person. Employers usually discover this after the move rather than before, which is the expensive order.

Handling a move properly

  1. Register before the first payment in a new state. Withholding and unemployment accounts take time to obtain and are needed from the first pay period. Starting the registration after payroll has run is how penalties begin.
  2. Establish work state and residence state. They can differ, reciprocity agreements exist between some pairs, and the rules are not symmetrical. Get this wrong and you withhold in the wrong place for months.
  3. Check local taxes below state level. Cities and school districts levy their own taxes in several states, and they are the most commonly missed layer because payroll products vary in how well they detect them.

What follows an employee across a line

Income tax withholding for the work state and sometimes the residence state, unemployment insurance in one of them determined by a defined test, and local taxes where they exist. Separately, an employee working in a state can create a business presence with its own filing consequences.

That last point is the one that surprises people and it belongs to finance rather than payroll. The payroll question is answerable in a week; the tax presence question can take much longer and is better started early.

What to ask a payroll product

Which states it files in directly, whether it handles local taxes automatically from an address, how it determines the unemployment insurance state, and what it does when somebody works in several states in one period. The last case is where products differ most.

For remote workers who move mid year, ask how prior withholding is corrected. Products that can only be told the current state leave you to fix the year to date by hand, which is a laborious and error prone exercise.

Puerto Rico, which is not another state

Puerto Rico has its own tax system, its own forms and its own filing calendar, and a US payroll product that covers fifty states frequently does not cover it. Treat it as a separate jurisdiction in any selection rather than assuming inclusion.

Ask explicitly whether it is supported, by the product or by a partner, and what the process looks like. Discovering after go live that your one employee there needs a manual process is a common and avoidable outcome.
