Employer of record Costa Rica
Costa Rica has become one of the default nearshore hiring markets for North American companies: a large bilingual professional workforce, an established services export sector, and time zones that overlap the full US working day. An employer of record lets you employ there without incorporating: the EOR's Costa Rican entity signs the employment contract, registers the worker with the Caja, the national social security fund, runs payroll and statutory benefits, and invoices you one monthly total. What follows is the shape of the obligations the EOR is carrying, so you can judge a quote by whether it accounts for all of them.

How an EOR hire in Costa Rica runs
- Offer and contract through the EOR entity. You agree the role, salary and start date with your candidate; the EOR issues an employment contract under Costa Rican labour law in Spanish, naming its local entity as employer. Day-to-day direction of the work stays with you from the first day.
- Registration with the Caja and insurers. The EOR enrols the employee with the Caja Costarricense de Seguro Social, which funds health care and pensions through employer and employee contributions on reported wages, and puts mandatory occupational risk insurance in place. Registration precedes the first payroll, not the other way round.
- Monthly payroll and statutory extras. Each month the EOR pays salary in colones or as agreed, withholds employee contributions and income tax, remits the employer contributions on top, and accrues the statutory year-end bonus, the aguinaldo, which every Costa Rican employee receives in December as a legal entitlement rather than a discretionary payment.
- Changes, leave and termination handled locally. Salary changes, vacation, sick leave certified through the Caja and any eventual termination run through the EOR as legal employer. Costa Rican law attaches notice and severance entitlements to terminations without cause, scaled to length of service, and pricing an exit should happen before you need one.
What the employer actually funds in Costa Rica
The employer's monthly cost is salary plus a substantial layer of social contributions to the Caja and related funds, plus insurance, plus the accrual for the aguinaldo. Contribution money funds one of Latin America's longest-established universal health systems, which is part of why the market's talent pool is strong; it also means the on-cost layer is material, and a vendor quote that shows gross salary plus a flat fee without itemising the Costa Rican employer contributions is not showing you the real number.
Ask any EOR for a full-loaded monthly cost at your actual salary: contributions itemised, insurance, the year-end bonus accrual shown as a monthly line, and the vendor fee separated out. On this site, vendor fees are verified against each vendor's own published pricing so at least that line starts honest.
Where an EOR fits, and where it stops fitting
For one to a handful of professional hires, the EOR math is straightforward: no incorporation, no local counsel on retainer, no learning curve on Caja filings, and a clean exit if plans change. Costa Rica's popularity as a shared-services and engineering hub means most established EOR vendors operate there, so there is real price competition to use.
At larger headcount, or for operations that want free-zone tax regimes designed for export services companies, running your own entity starts to win: the per-employee fees stack up, and free-zone benefits attach to the operating company itself. The common path is starting on an EOR, proving the market, then transferring staff to your own entity; check the transfer terms in the EOR contract before you sign it. Employment documents control, and nothing here is legal or tax advice.
Common questions
- Who is the legal employer when I use an EOR in Costa Rica?
- The EOR's Costa Rican entity. It signs the employment contract, registers the worker with the Caja, and carries the legal employer obligations while you direct the day-to-day work.
- What is the aguinaldo in Costa Rica?
- The statutory year-end bonus every employee receives in December, accrued from a year of pay. It is a legal entitlement the EOR must fund and should appear as a line in your monthly cost, not a surprise at year end.
- Can I hire Costa Ricans as contractors instead?
- Genuinely independent contractors, yes. But a full-time, supervised role dressed as a contractor arrangement carries reclassification risk with back contributions, so dependent roles belong on an employment contract through an EOR or your own entity.
- How fast can an EOR onboard in Costa Rica?
- Typically days once the candidate's documents are in, against the weeks to months of incorporating and registering your own entity. Vendor onboarding speed varies; it is a fair question to make vendors answer in writing.
