Cloud and software as a service stopped narrowing this market some years ago, because nearly every product is delivered that way. What the words should now prompt is a different set of questions: where the candidate data physically sits, what the service promises when it is unavailable, and which country's employment and privacy rules the contract was written for.

Asking the questions the label used to answer

  1. Ask where candidate data is stored and processed. Region, sub processors, and whether support staff outside that region can view records. Candidate data includes people who never worked for you, and their expectations are the same as employees'.
  2. Read the availability commitment. Not the marketing number, the contractual one, with the remedy. Recruitment is bursty and an outage during an assessment window is an expensive hour.
  3. Check which market the product was built for. Job board integrations, right to work checks, privacy notices and salary display rules are all local. A product that is excellent in one market can be missing the basics in another.

What the delivery model changed and did not

It changed procurement, updates and access: no servers, continuous releases, and a recruiter can work from anywhere. It did not change who is accountable for the candidate data, which remains the employer regardless of who hosts it.

The practical consequence is that the contract and the security questionnaire matter more than they did, and the infrastructure matters less. Time spent on sub processor lists is better spent than time spent on hosting architecture.

Australia, and why local fit is not cosmetic

Australian hiring runs on its own job boards, its own privacy regime and its own award based pay structures, which reach into hiring through the terms an offer can be made on. A product without local job board integration makes a recruiter post twice, every time.

Ask for local reference customers and for the list of integrated boards by name. That single list distinguishes products genuinely operating in a market from ones that merely accept payment in its currency.

The terms worth negotiating in a cloud contract

Data return on exit, in a usable format and within a stated period. Notice before a sub processor changes. A price cap on renewal. And deletion on request that the vendor can evidence, because candidate retention duties do not pause because the data is hosted.

None of these is exotic and all are commonly conceded when asked before signature. After signature they are renewal conversations, which is a much weaker position.

Is there any difference between cloud and SaaS here?
Not usefully. Both describe the same delivery for almost every product in this market, and the distinction survives mainly in vendor copy.
Can we insist on data staying in our country?
Often yes, at a price or on a specific plan. Ask early, because retrofitting a region is usually a migration rather than a setting.
What happens to candidate data if we stop paying?
Read the clause. Retention periods after termination vary widely and some are short enough to lose records you are still obliged to hold.
